Privacy Policy for California Residents

NIKON AM SYNERGY INC. (the “Company”, “NAMS”, “we”, “us”, or “our”) recognizes the importance of proper personal information management. In accordance with the Nikon Group Privacy Statement and all applicable laws, personal information will be handled as described below.

 

In this privacy policy, we explain how we collect and use your personal data. Nikon respects privacy and acknowledges that processing personal data in a lawful and proper manner is an important social responsibility and declares that it will strive to protect personal data.  This privacy policy applies to individuals worldwide who interact with our website, products, and services.

1.Who we are

We are Nikon AM Synergy Inc. with headquarters located at 3550 Carson Street, Long Beach, California 90808. We are part of the Nikon Group. We are responsible for the collection and use of your personal data described in this privacy policy.  References to “Company”, “NAMS”, “we”, “us”, and “our” throughout this notice refer to NAMS.

We have determined our respective responsibilities for compliance with the obligations under applicable privacy legislation for processing your personal data in relation to our global processing activities by means of an arrangement between us. In summary, we have arranged that if you want to exercise your rights, such as your right to access, correct, erase, restrict, object or port personal data or to withdraw your consent, or if you have any questions about the processing of your personal data, you can contact NAMS in accordance with Section 11 below. NAMS and its affiliated entities, such as Nikon Corporation, Nikon Advanced Manufacturing Inc. and Nikon Americas Inc., will assist each other where necessary to ensure that you can exercise your rights and your questions will be properly addressed.

2.What personal data we collect and why

We collect personal data only to the extent that is adequate, relevant, and necessary for the stated purpose of collection in compliance with applicable laws. 

For purposes of this privacy policy, “Personal Data” or “Personal Information” refers to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

2.1 Overview of NAMS processing activities


NAMS collects personal data only to the extent that is adequate, relevant, and necessary to the stated purpose of collection, and will do so in a lawful and fair manner. Such lawful purposes include, but are not limited to:

2.2 Legal basis

NAMS processes your personal data to provide our products and services to you, to comply with our legal obligations, for our legitimate business interests or interests of a third party, or on the basis of your consent.

When we process your personal data for our legitimate interests or the interests of a third party, we will take reasonable measures to prevent unwarranted harm to you. Our legitimate interests include, for example, our interest of improving our product and services by storing contact details, reducing our costs, improving our newsletters and websites by analyzing which parts of our communications are most relevant for you or of securing our services and facilities, such as the purposes mentioned in “Section 2—What personal data we collect and why.” Where we process your personal data for our legitimate interests or the interests of a third party, you have the right to object at any time on grounds relating to your particular situation (please see “Section 7—Your rights,” below).

You can withdraw your consent at any time by following the specific instructions in relation to the processing for which you provided your consent, by adjusting your setting (if available), or by reaching us through the contact details in “Section 11— Contact details for your privacy inquiries,” below, for your privacy inquiries. Where we process your personal data for a purpose other than that for which it was initially collected (and we rely on a legal basis other than consent or complying with legal obligations for this new purpose), we will ascertain whether processing for this new purpose is compatible with the purpose for which the personal data were initially collected. More information on this assessment is available upon request (please see “Section 7—Your rights,” below).

 

3. How we collect your data

Most of the personal data we process is information that you knowingly provide to us directly or through third parties. However, in some instances, we process personal data that we are able to infer about you based on other information you provide to us or from our interactions with you, or personal data about you that we receive from a group company or a third party with your knowledge (please see “Section 4—Information sharing,” below, and “Section 2—What personal data we collect and why,” above).

In summary, we collect data in the following ways:

  • Directly from you: When you fill out a form, contact us for support, or purchase a product or services.
  • Automatically: When you browse our website, we may collect technical data and usage information.
  • From third parties: Business partners, recruiting agencies, or other Nikon Group entities.

We do not use cookies, pixels, and other similar technologies to collect information about your browsing activities over time or across different websites following your use of our site.

If you refuse to provide personal data that we require for the performance of the contract or compliance with a legal obligation, we may not be able to provide all or parts of the services you have requested from us.

 

4. Information sharing

We will process some of your personal data locally. However, as a global organization, many of our business activities can also be carried out (and business efficiencies achieved) by processing or consolidating information about you in specific or centralized databases and systems located at specific secured facilities worldwide. As a result, your information may be shared with other entities within the Nikon Group. However, each Nikon Group company and those other systems and databases will only collect, receive, use, share or otherwise process such personal data in accordance with applicable laws, this privacy policy, and our Nikon Group Privacy Protection Statement www.nikon.co.jp/main/eng/privacy_policy.htm. Moreover, internally we maintain a strict access policy with regard to the processing of personal data. Only a limited group of authorized Nikon staff on a need to know basis will have access to your personal data.

As a general rule, we do not share your personal data with anyone outside the Nikon Group. However, we may share your personal data with trusted third parties that perform business functions or provide services to us. All such third parties will be required to adequately safeguard your personal data, subject to agreements that correspond to the requirements of applicable laws. Your personal data may also be shared for investigations (e.g. disclosure to prevent crime or fraud, or to comply with a court order or legislation).  We do not sell your personal data, nor collect, retain, use, or disclose your personal data for cross-context behavioral advertising, nor “sell” or “share” your personal data as defined in the California Consumer Privacy Act of 2018, as amended, including by the California Privacy Rights Act (“CCPA”).

 

5. Security measures and data retention

We secure your personal data in accordance with our information technology (IT) and security policies to protect against unauthorized use, unauthorized access and wrongful modifications, loss or destruction. Your personal data will be stored no longer than is necessary for the purposes they were obtained, including compliance with legal and fiscal obligations and dispute resolution.

 

6. International transfers of personal data

Given our global operations, your personal data may be transferred to Nikon Group entities and trusted third parties in countries whose laws may not afford the same level of protection. Where necessary, NAMS will ensure that adequate safeguards are in place to comply with the requirements for the international transfer of personal data under applicable privacy laws.  For transfers of data from the European Economic area (EEA), UK, or Switzerland, this may include using data transfer mechanisms like the European Commission’s Standard Contractual Clauses.

 

7. Your rights

Depending on your place of residence, you may have certain rights regarding your personal data. We are committed to facilitating these rights. To exercise any of your rights, please contact us using the information in “ Section 11—Contact details for your privacy inquiries.”

We will respond to your request consistent with applicable law and will verify your identity before processing your request.

This includes the rights to: (1) access your data, (2) rectify your data, (3) erase your data, (4) restrict the processing of your data, (5) receive a file of your personal data, and (6) object to the processing, and where we have asked for your consent, withdraw this consent. These rights will be limited in some situations. For example, we may deny your request for access when necessary to protect the rights and freedoms of other individuals or in case the processing of such data is necessary for compliance with legal obligations. As an additional example, the right to data portability does not apply in case the personal data was not provided by you or if we process the data not on the basis of your consent or for the performance of a contract.

Please note that we may need you to provide additional information to confirm your identity. You can also contact us if you have any questions, remarks or complaints in relation to this privacy policy.

7.1 Right to access

You may ask us whether or not we process any of your personal data and, if so, receive access to that data in the form of a copy. When complying with an access request, we will also provide you with additional information, such as the purposes of the processing, the categories of personal data concerned as well as any other information necessary for you to exercise the essence of this right.

7.2 Right to rectification

You have the right to have your data rectified in case of inaccuracy or incompleteness. Upon request, we will correct inaccurate personal data about you and, taking into account the purposes of the processing, complete incomplete personal data, which may include the provision of a supplementary statement.

7.3 Right to erasure

You also have the right to have your personal data erased, which means the deletion of your data by us and, where possible, by any other controller to whom your data has previously been made public by us. However, the right to erasure of your personal data only applies in certain limited circumstances, as prescribed by applicable law. For example, the right to erasure includes situations where your personal data are no longer necessary in relation to the initial purposes for which they were processed as well as situations where they were processed unlawfully. Due to the way we maintain certain services, it may take some time before backup copies are erased.

7.4 Right to restriction of processing

You have the right to obtain the restriction of the processing of your personal data, which means that we suspend the processing of your data for a certain period of time. Circumstances which may give rise to this right include situations where the accuracy of your personal data was contested but some time is needed for us to verify their (in)accuracy. This right does not prevent us from continuing to store your personal data. We will inform you before the restriction is lifted.

7.5 Right to receive your file (data portability)

Your right to data portability entails that you may request us to provide you with your personal data in a structured, commonly-used and machine-readable format and to have such data transmitted directly to another controller, where technically feasible. Where technically feasible, we will transmit your personal data directly to another controller upon your request.

7.6 Right to object

You also have the right to object to the processing of your personal data, which means you may request us to no longer process your personal data. This only applies in case the ‘legitimate interests’ ground (including profiling) constitutes the legal basis for processing (please see “Section 2— What personal data we collect and why,” above).

At any time and free of charge you can object to direct marketing purposes in case your personal data are processed for such purposes, which includes profiling purposes to the extent it is related to such direct marketing. In case you exercise this right, we will no longer process your personal data for such purposes.

7.7 Right to Withdraw Consent

Where processing is based on your consent, you can withdraw it at any time.

7.8 Right to Lodge a Complaint

You have the right to lodge a complaint with the local applicable authority.

 

8. Children’s Privacy

Our website and services are not directed to or intended for use by children under the age of 16.  We do not knowingly collect personal data from children under age 16.  If we learn that we have inadvertently collected personal data from a child under 16, we will delete such data promptly.  If you believe a child under 16 has provided us with personal data, please contact us.

 

9. Do Not Track Signals

Some web browsers may transmit “Do Not Track” (DNT) signals (including Global Privacy Control (GPC)) to the websites you visit.  We do not currently respond to or alter our practices when we receive a DNT signal (including GPC signal) because we do not “sell” or “share” your personal data.

 

10. How we look after this policy

We will update this privacy policy from time to time with notice of any substantive changes.  This version of our Privacy Policy replaces any previous versions.

Supplemental California Consumer Privacy Act Privacy Policy

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (the “CCPA”) requires Nikon AM Synergy Inc. (“NAMS” or “we” or “us”) to provide certain information about our data processing practices to California residents, in addition to the disclosures in our general privacy notice and other privacy notices provided to California residents at or before the point of collecting personal information.

If you have a visual disability, you may be able to use a screen reader or other text-to-speech tools to review the contents of this Privacy Policy.

Scope

In this Supplemental CCPA Privacy Policy, NAMS provides disclosures for the 12 months preceding the effective date of this policy as required by the CCPA vis-à-vis California residents. Subject to applicable exceptions and limitations, California residents have certain rights extended to them under the CCPA as further described in this Supplemental CCPA Privacy Policy. 

Right to Know About Personal Information Collected, Disclosed, or Sold

This Supplemental CCPA Privacy Policy describes the personal information we collect, use, disclose and sell about California residents. If you are a California resident, then you have the right under the CCPA to request that we disclose what personal information we collect, use, disclose and sell about you specifically (“right to know”). To submit a request to exercise the right to know, please submit an e-mail request to info@nikonamsynergy.com_ and include “California Request to Know” in the subject line. Please specify in your request the details you would like to know, including any specific pieces of personal information you would like to access.

We will ask that you provide certain information to verify your identity, such as a code sent to an email address we may have on file for you. If you have a password-protected account with us, we may verify your identity through our existing authentication practices for your account. The information that we ask you to provide to verify your identity will depend on your prior interactions with us and the sensitivity of the personal information at issue. We will respond to your request in accordance with the CCPA. If we deny your request, we will explain why.

Sensitive Personal Information

Under the CCPA, California residents also have certain rights related to that information considered sensitive personal information. Purpose of Collecting – B2B Contacts & NAMS Employees

The following is a description of the purposes for which we collected personal information over the 12 months preceding the effective date of this policy from: (1) individual representatives of our prospective, current or past suppliers and customers (collectively, “B2B contacts“); and (2) our prospective, current and past employees and other personnel (collectively, “employees“).

 

We use the personal information that we collect from B2B contacts for the following purposes:

 

  • To order products and services from companies and other organizations;
  • To provide products and services to companies and other organizations;
  • To process payments and execute transactions;
  • To initiate or receive shipments;
  • To communicate with our B2B contacts, including to manage customer and vendor relationships, provide or receive customer service, pose or answer questions, raise or address concerns, and maintain business relationships;
  • To maintain, secure, upgrade and enhance our online vendor and customer management systems;
  • To enforce our contracts with vendors and customers;
  • To better understand how we do business with vendors and customers;
  • To send informational or promotional communications;
  • To carry out other purposes that are disclosed to B2B contacts and to which they consent;
  • To carry out any other purpose permitted or required by law;
  • To verify or maintain the quality or safety of our services and products; and
  • To improve, upgrade, or enhance our services and products.

 

We use the personal information that we collect from employees for the following purposes:

 

  • To recruit employees, including evaluations of qualifications for possible employment or internship possibilities and employee onboarding;
    • To perform the services or provide the goods reasonably expected by our employees in their role as our employees, including those services and goods that are reasonably necessary for us to administer the employment relationship and for our employees to perform their duties;
    • To detect security incidents that compromise the availability, authenticity, integrity, and confidentiality of stored or transmitted personal information, including in or via our premises, computers, software, networks, communications devices, and other similar systems;
    • To resist malicious, deceptive, fraudulent or illegal actions directed at us and to prosecute those responsible for those actions;
    • To ensure the physical safety of natural persons;
    • For short-term, transient use;
    • To perform services on behalf of us;
    • To perform functions that are required under laws that apply to us; and
    • To fulfill the other purposes set forth in our privacy notices at collection to employees.

 

No Sale or Sharing of Personal Information

We do not sell, nor share for cross-context behavioral advertising, any of the categories of personal information that we collect about California residents. We do not have actual knowledge that we sell or share the personal information of California residents under 16 years of age. We do not use sensitive personal information for purposes other than those referred to in Subsection 1798.121(a) of the CCPA.

 

Additional Rights Under the CCPA:

As a California resident, and subject to certain exceptions, you have the following rights under the CCPA:

1.Right to Request a Correction or Deletion of Personal Information

If you are a California resident, then you have a right under the CCPA to request that NAMS correct any personal information provided, and can also request the deletion of personal information that we collect or maintain about you. To submit a request to correct or delete personal information, please submit a request (see “Section 5—Contact for More Information,” below) and include “California Request to Correct” or “California Request to Delete” in the subject line, respectively. Please specify in your request the personal information about you that you would like to have corrected or deleted, and is all your personal information as required by the CCPA.

We will ask that you provide certain information to verify your identity, such as a code sent to an email address we may have on file for you. If you have a password-protected account with us, we may verify your identity through our existing authentication practices for your account. The information that we ask you to provide to verify your identity will depend on your prior interactions with us and the sensitivity of the personal information at issue. Once we have verified your identity, we will ask you to confirm that you wish to have your personal information corrected or deleted. Once confirmed, we will respond to your request in accordance with the CCPA. If we deny your request, we will explain why.

2. Right to Opt-Out of the Sale or Sharing of Personal Information

Under the CCPA, you have the right to opt-out of the sale or sharing of your personal information by a business. However, we do not, and will not, sell nor share any of the categories of personal information that we collect about California residents for cross-context behavioral advertising.

3. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

You will not be discriminated against for exercising any of your rights under the CCPA.  Such discrimination would be in violation of Cal. Civ. Code §1798.125.

4. Authorized Agent

You can designate an authorized agent to make a request under the CCPA on your behalf if:

  • The authorized agent is a natural person or a business entity registered with the Secretary of State of California; and
  • You sign a written declaration that you authorize the authorized agent to act on your behalf.

 

If you use an authorized agent to submit a request to exercise your right to know or your right to request deletion, please have the authorized agent take both of the following steps in addition to the steps described above:

If you provide an authorized agent with power of attorney pursuant to Probate Code sections 4000 to 4465, it may not be necessary to perform these steps and we will respond to any request from such authorized agent in accordance with the CCPA.
